Regulation 177D of the Dangerous Good in Hong Kong

Dear Customers,

We would like to draw you the attention that, in accordance with the Hong Kong Regulation 177D of the Dangerous Good (general) regulations (Cap.295B),  a  freight container containing Dangerous Goods (DG) :
 
a) In HKG category 2, or in HKG category 5, IMO class 1 or 2 or

b) Of the types specified in the 177d table.

shall only be allowed to store at the terminal during the first 72 hours of the freight container arriving at the terminal. 

For other categories of DG and subject to Regulation 10 which deals with Category 1, the maximum period of storage of the DG container is 21 days from the date of its arrival at the terminal. 

It is a criminal offence to contravene Regulation 177d which is punishable by imprisonment and / or a fine.  Pursuant to section 11 of the DG ordinance (Cap. 295), the Director of Marine has the power to remove any DG which are stored or are otherwise dealt with contrary to any regulations at the full expense of the owner.

Attached is the notice from Modern terminals Limited (MTL) in related to the mentioned above ordinance. To raise the seriousness of the subject, with immediate effect, MTL will implement additional overtime charges of 10 times of the overtime storage rate for all overstaying DG container.

Therefore, we would like to seek for your co-operation to ensure the full compliance of the aforesaid requirements, failing which may cause prosecutions against the concerned parties. We, as a carrier, have to hold the merchant fully liable for all liabilities and expenses which incurred/ will be incurred, including but not limited to any fine if imposed by the authorities.
