Equipment Substitution

17.1 General

A) If carrier is unable to provide the container type/size required by shippers at time of booking due to lack of available empty equipment or to other unavoidable operational constraints, carrier has the option to substitute other type/sizes of container for per container rated shipments.

B) The following clause must be put on all Bills of Lading covering shipments freight under this rule:-

"EQUIPMENT SUBSTITUTION PERFORMED"

[Indicate the size of equipment requested by shipper and the size of equipment provided by carrier under this Rule]

C) Equipment substitution cannot be applied if there is no measuring certificate issued by official measurers. In the absence of such certificate, the ocean freight shall be assessed based on the equipment utilized.

D) Equipment Free time, Demurrage and Detention Charges will be assessed per the actual equipment type.

E) Substitution of equipment will not affect the responsibilities and liabilities to Shipper or Consignee.

17.2Equipment Substitution (applicable for TAT E/B ONLY)

A. Not applicable to Temperature Controlled containers and Not applicable to Consolidated Cargo.

(a) When a 40'/45' container is substituted for a 20' container and the quantity of cargo stowed therein exceeds 29.75 CBM or 18,500 kgs. the rate and charges applicable for cargo shipped in 40' containers shall apply to such shipments.

(b) Provided that the cargo as presented to the Carrier is physically capable of being stowed in the equipment originally requested, the minimum and or rate applying on the shipment will be for the container booked. The intent of such arrangement is to place cargo interests in exactly the same position as would have applied had the equipment originally ordered been utilized.

(d) Carrier may at its convenience/option substitute a 40 ft. standard or Hi-Cube dry container, with a 45 ft.

standard dry container provided that the quantity of cargo stowed therein does not exceed 66.5 cbm and subject to no single piece exceeding 39'6" in length. In such event the rate applicable for the shipment in the 40 ft. container shall apply for the shipment in the 45 ft. container.

(e) If the Tariff provides for a 45ft rate, a 45ft container may not be substituted for a 40ft container and rated as a 40ft container.

(f) When a 40' Flat Rack High Cube / 40 Superrack Container is substituted for a 40' Flat Rack, the ocean freight and charges assessed shall be the same as what would have been assessed is a smaller container had been furnished. All other charges including DDC will be applicable.

(g) When a 40 Superrack Container is substituted for a 40' Flat Rack High Cube, the ocean freight and charges assessed shall be the same as what would have been assessed is a smaller container had been furnished. All other charges including DDC will be applicable.

(h) When a 40' Open Top High Cube Container is substituted for a 40' Open Top, the ocean freight and charges assessed shall be the same as what would have been assessed is a smaller container had been furnished. All other charges including DDC will be applicable.

B. The following applies to Refrigerated Containers only.

Carrier may, at its option substitute a type of equipment other than that which was booked or ordered by the shipper or his agent, subject to the following conditions:

A 40' container may be substituted for a 20' container, subject to a maximum loading of 16KT at the rate and charges applicable to a 20' container. When cargo is loaded in excess of the above quantities, the applicable revenue ton rate or per container rate and charges for a 40' container will apply.

C. Where equipment is substituted under the provisions of this rule, Bills of Lading must be claused, "Equipment Substitution".

17.3 Equipment Substitution (applicable for TAT W/B ONLY)

A.Dry Containers

(a) (i) Standard dry containers may be substituted by other standard or Hi-Cube dry containers.

(ii) Open top and flat rack containers may be substituted either in lieu of each other or each by other open

top or flat rack containers, as the case may be.

(b) Provided that the cargo as presented to the Carrier is physically capable of being stowed in the equipment originally requested, the minimum and or rate applying on the shipment will be for the container booked. The intent of such arrangement is to place cargo interests in exactly the same position as would have applied had the equipment originally ordered been utilised.

(d) Carrier may at its convenience/option substitute a 40ft. standard or Hi-Cube dry container, with a 45 ft.

standard dry container provided that the quantity of cargo stowed therein does not exceed 66.5 cbm and subject to no single piece exceeding 39'6" in length. In such event the rate applicable for the shipment in

the 40 ft. container shall apply for the shipment in the 45 ft. container.

(e) Flat Rack High Cube / Superrack / Open Top High Cube

(i) When a 40' Flat Rack High Cube / 40 Superrack Container is substituted for a 40' Flat Rack, the ocean freight and charges assessed shall be the same as what would have been assessed is a smaller container had been furnished. All other charges including DDC will be applicable.

(ii) When a 40 Superrack Container is substituted for a 40' Flat Rack High Cube, the ocean freight and charges assessed shall be the same as what would have been assessed is a smaller container had been furnished. All other charges including DDC will be applicable.

(iii) When a 40' Open Top High Cube Container is substituted for a 40' Open Top, the ocean freight and charges assessed shall be the same as what would have been assessed is a smaller container had been furnished. All other charges including DDC will be applicable.

(iv) A 40' high cube container may be substituted for a 40' container.

(v) A 40' superrack container may be substituted for a 40' high cube or 40 container.

B. Non-working Temperature Controlled Containers for Dry Containers

The Carrier may at its option substitute dry cargo containers with non-working temperature-controlled

containers, subject to the following conditions:

(i) Substitution of dry containers for cargo that requires temperature control, insulation, or the like is not allowed.

(ii) At no time during the thru-transportation may the temperature controlled container be activated,

operable, or otherwise working.

(iii) The same size dry container may be substituted with the same size temperature controlled container. Freight will be assessed at 85 percent of the dry container ocean rate.

The same size dry container may be substituted with the same size temperature controlled container. Freight will be assessed at 70 percent of the dry container ocean rate - Not applicable for dry container shipments of Bric-a-Brac; Alcoholic/Non-Alcoholic Beverages viz: Beer, Wines, Spirits, Mineral Water, Fruit Juices, NOS; Chemicals Hazardous, NOS; Auto Parts, NOS; Vegetables, NOS; Bulbs/Flowerbulbs/Shallots, NOS

(iv) A 20ft dry container may be substituted with a 40ft or 45ft temperature controlled container. Cargo

will not exceed 29.75 cubic meters (CBM) or 18,500 kilos. Freight will be assessed at 100 percent of the 20ft dry container ocean rate.

(v) A 40ft dry container may be substituted with a 45ft temperature controlled container. Cargo will not exceed 66.50 cubic meters (CBM) and no single piece shall exceed 39'6" in length. Freight will be assessed at 100 percent of the 40ft dry container ocean rate.

C. Operating Temperature Controlled Containers

Substitution of operating temperature controlled equipment is prohibited. The external length and/or type of temperature controlled container supplied and shipped by the Carrier, whether booked by the Shipper/Consignee or not, shall determine the applicable rating for each individual shipment.
