The Ocean Charges including Freight Rates, Surcharge and Fees in
your Rate Document are governed by the Rate Document Terms and Conditions,
together with the terms and conditions specified in your Rate Document and
carrier’s prevailing governing tariffs on www.OOCL.com at the time of shipment.
In the event of any inconsistency between any of the following documents, the
document first listed below shall govern:
(i) the Rate Document Terms and Conditions;
(ii) except in respect of “Fixed Surcharges”, Carrier’s prevailing
governing tariffs on www.OOCL.com
at the time of shipment;
(iii) Your Rate Document

Except for Surcharge and Fees marked as “Fixed” in your Rate Document, the
quantum of other Surcharge and Fees in your Rate Document are set at maximum
rates, valid until further notice (unless specified) and governed by and subject
to carrier’s prevailing tariff(s) published on www.OOCL.com at the time of
shipment. Other Surcharge and Fees applicable include Surcharge and Fees
introduced to cover a change of requirements or additional services at your
request, contingency charges, local surcharges or other charges due to
extraordinary conditions beyond OOCL’s control, if relevant, which are available
at carrier’s prevailing governing tariff(s) on www.OOCL.com at the time of
shipment, and specified by OOCL in its invoice(s) when your booking is accepted.
Booking acceptance is subject to availability of vessel, space and equipment.
Carriage of goods is always subject to the terms and conditions of the carrier's
Bill of Lading. OOCL* and carrier are defined in OOCL Bill of
Lading.*
2. Ocean Charges including Freight Rates, Surcharge and Fees
will be valid from Rate Effective Date until further notice (unless specified)
(the “Rate Effective Period”). OOCL will initiate negotiation of Ocean Charges
including Freight Rates and Surcharge and Fees when necessary and the new agreed
Ocean Charges including Freight Rates, Surcharge and Fees shall apply with
immediate effect unless otherwise agreed by both parties to the Rate Document.
3. Unless otherwise specified in writing, your Rate Document is valid
subject to the following:
a. the entity listed as the Eligible
Shipping Party is the shipping party, as determined by
OOCL;
b. Freight Rates, Surcharge and Fees for shipments is
valid within the Rate Effective Period
provided that the booking
is made and shipment delivered(Note 1); and the time of
shipment
is within the Rate Effective
Period;
c. the entity listed as the Eligible Named Account, if
any, is specified as the Shipper or Consignee on
the OOCL Bill
of Lading; and
d. the Rate Folder number is given at time of
booking.
4. Your Rate Document is subject to currency exchange at the
time of shipment. For Iran import and export shipment, Freight Rates and all
applicable Surcharge and Fees should be paid in non-US dollar
currency.
5. Definitions used:-
a. Fixed means Surcharges
or Fees are fixed;
b. Tariff means Surcharges or Fees are set at
the Carrier’s prevailing governing tariffs on
www.OOCL.com at
the time of shipment;
c. Rate Document (as maybe supplemented
from time to time) means the binding agreement with
OOCL for
provision of carriage service at the time of
shipment;
d. applicable (when used) means the Surcharge and Fees
that will apply on provisions of carriage
service at the time of
shipment;
e. B/L Release means Surcharge or Fees that is only
applicable if Bill of Lading is released from the
location
specified;
f. TBD means Surcharge or Fees is to be determined,
whether prepaid or collect, in each case in
accordance with
the relevant Tariff Rules at Carrier’s prevailing governing tariffs
on
www.OOCL.com at the time
of shipment, or if no rules exist then as decided by OOCL in its
sole
discretion.
6. Your Rate Document is confidential,
the contents of which shall not be disclosed to competitors of OOCL.
7.
Your Rate Document shall be governed by English Law.
Note 1:A shipment shall be deemed to have been delivered
when the full bill of lading quantity has been received, and the time of
shipment for Asia-Europe Trade, Intra-Asia Trade and Australian Trade (Except
for Australia and New Zealand to/from United States/Canada/Mexico/Panama) is on
the actual vessel departure date of the vessel named in the bill of
lading.
The time of shipment for all
other shipments including Australia and New Zealand to/from United
States/Canada/Mexico/Panama is when the shipment is loaded in case of carrier
haulage or when full container gate-in at container yard in case of merchant
pre-carriage.
